Surrogacy
If you plan to take part in commercial surrogacy arrangements, be aware of all legal and other risks involved.
Although it is not illegal, surrogacy is not regulated by law across east Africa. Get independent legal advice.
Research prospective clinics to ensure that you're dealing with a reputable organisation.
The Australian High Commission can't provide:
- legal advice about surrogacy
- information on clinics or agencies.
The processes required to obtain Australian citizenship and an Australian passport can take several months. You should allow time for these processes, including planning for a lengthy stay in the country where the child is born.
Please bear in mind that commercial surrogacy is a crime in all Australian states and territories, except the Northern Territory. In the Australian Capital Territory, New South Wales, and Queensland it’s illegal for residents to enter into international commercial surrogacy arrangements.
The Smartraveller website has important general information on international surrogacy.
For information on Australian citizenship or Australian visa requirements for children born overseas, see International Surrogacy Arrangements on the website of the Department of Home Affairs.
Once the child has acquired the citizenship, you may apply for a passport at the Australian High Commission in Kenya.
The passport application lodgement process is the same as any child application, except that in addition to those requirements you also need to provide a B4 – Child born through surrogacy (PDF 190.88 KB) and:
- a B5 – Child born through surrogacy – supplementary consent overseas (PDF 566.65 KB), if the surrogate consents to the child having a passport
- a B7 – No further court orders (child application) (PDF 567.21 KB), if an Australian court order has removed the surrogate’s parental responsibility
- a B9 – Child without full parental consent (PDF 123.4 KB) if the surrogate doesn’t consent to the child having a passport and there is no Australian court order that removes the surrogate’s parental responsibility.

Emergency passport
In special circumstances an emergency passport can be issued to Australian citizens where either they cannot complete all requirements (other than identity, citizenship and entitlement) for the issue of a full validity passport, or they can complete all requirements but there is an exceptional need to travel urgently.
The Emergency passport can be issued within 3-4 business days, contains only 5 visa pages and its validity is usually limited to a period of seven months. A full validity passport may be applied for simultaneously, utilising the same application as for the Emergency Passport.
It is the responsibility of the holder to ensure the travel document is suitable for entry, transit and exit for any ongoing travel including visa requirements.
If you need to travel within the next 48 hours, please contact the Australian High Commission immediately.
